Cancellation & Refund Policy

This policy governs the cancellation of services and the conditions under which refunds may be issued by Simonclicks ("We," "Us," or "Our") for projects involving AI Image Generation, AI Video Generation, and related editing services (the "Services").

1. Non-Refundable Deposit and Project Commencement

1.1 Project Deposit

A non-refundable deposit, typically [Specify Percentage, e.g., 50%] of the total project fee, is required to formally secure and commence any project with Simonclicks.

1.2 Definition of Project Commencement

A project is deemed to have officially commenced when any one of the following actions has occurred:

• The required deposit has been received by Simonclicks.

• The Client has submitted the final Creative Brief, text prompts, or necessary input files (e.g., product images, reference materials).

• Simonclicks has begun the Discovery & Prompt Engineering phase (Phase 1) or has generated the Initial Concepts (Phase 2).

2. Cancellation of Services

2.1 Cancellation Before Project Commencement

If the Client cancels the Services before the project is deemed to have commenced (as defined in Section 1.2), any fees paid will be fully refunded, minus any transaction processing fees incurred by Simonclicks.

2.2 Cancellation After Project Commencement

If the Client cancels the Services after the project has commenced, the initial [Specify Percentage, e.g., 50%] non-refundable deposit will be forfeited immediately.

2.3 Partial Completion Billing

If the project is canceled after the initial concepts have been delivered and accepted, or after significant work has been completed (e.g., subsequent batches in a large project), the Client will be responsible for paying for all work completed up to the date of written cancellation, calculated based on the following milestones:

Due to the custom and immediate nature of digital content created through AI services, the following refund rules apply:

3.1 Non-Refundable Services

All fees and payments for accepted, finalized, or delivered digital visual assets are non-refundable. Since the Deliverables are custom-created intellectual work, they cannot be 'returned.'

3.2 Guarantee of Effort and Revisions

Simonclicks guarantees that we will continue to iterate and refine the Deliverables until they align with the specifications of the initial Creative Brief using our Unlimited Revisions policy. A refund request based purely on creative preference after the initial concepts have been approved will be declined, as our commitment is fulfilled through the revision process.

3.3 Refund for Service Non-Delivery

If Simonclicks, for unforeseen internal reasons, is unable to complete the agreed-upon project or deliver the agreed-upon number of visuals, the Client will receive a pro-rata refund for the portion of the Services that could not be delivered.

4. Revision-Related Adjustments

A refund will not be granted in situations where:

• The Client's requirements substantially change after Phase 1, requiring a new brief (this will result in a new project fee).

• The Deliverables are deemed accepted (as per the Terms & Conditions).

• The request for a refund is based on subjective dissatisfaction that could have been resolved through the revision process.

5. Dispute Resolution

Any disputes regarding cancellation fees or refund amounts should be submitted to Simonclicks in writing within [Specify Number, e.g., 7] business days of the cancellation or project delivery date. We are committed to resolving payment disputes fairly and professionally.
